- 1. General - I reserve the right to refuse any commission for any reason. - Clients must be 18+ - Clear references help me a lot! be as descriptive as you can or even pull out a pen and paper. - Major changes after the sketch stage may require an additional fee. please decide what i am drawing before we complete the thumbnail stage so this can be avoided! 2. Payment - Work will not begin until payment is received. . Refund Policy - Full refunds are only available if I have not started the commission - If work has begun, refunds may be partial depending on progress - No refunds will be given once the final artwork has been delivered. - Chargebacks are prohibited. If a chargeback is filed, you will lose rights to the artwork and i will use it myself and you will be blacklisted from future commissions. 4. Turnaround Time - Typical turnaround is 3 days to 3 weeks, depending on complexity, and my physical health. - Delays may occur due to personal circumstances, but clients will be informed. - Clients who delay responses for more than 7 days may have their commission paused or pushed back in the queue until there is a response 5. Revisions - Minor revisions are allowed during the sketch phase. - Major revisions after approval of the sketch may incur an additional fee. - Unlimited revisions are not included. 6. Usage Rights Unless otherwise agreed: The Artist (me) retains full copyright to the artwork. I reserve the right to: - Post the artwork on social media - Use it in portfolios - Use it for promotional purposes The Client may: - Use the artwork for personal use - Post the artwork with credit to the artist The Client may NOT - Use the artwork commercially - Mint the artwork as an NFT - Use the artwork for AI training or datasets - Claim the artwork as their own - Remove my signature/watermark Commercial rights must be purchased separately --- 7. Commercial Use Commercial usage includes but is not limited to: - merchandise - advertising - monetized videos - games - books - brand logos Commercial rights require an additional licensing fee --- 8. AI & Data Protection - My artwork may not be used for AI training, machine learning datasets, or generative AI under any circumstances. - Uploading the artwork to AI training datasets or generation services is strictly prohibited. --- 9. Copyright I retain full copyright ownership of all artwork unless a written copyright transfer agreement is made. Purchasing a commission does not transfer copyright. 10. Harassment / Conduct I reserve the right to cancel a commission if the client: - behaves aggressively - harasses the artist - repeatedly violates the TOS Refunds in these cases are **not guaranteed**. --- ### 11. Chargebacks & Fraud Filing a chargeback after receiving artwork will result in: - permanent blacklist - revocation of usage rights - public posting of the commission as unpaid work if necessary for proof 12. Agreement By purchasing a commission, the client confirms they have read and agreed to these Terms of Service.
